Raporti Vjetor (2023) i Zbatimit të SSL-së tregon se nga buxheti i planifikuar për vitin 2023, vetëm 32% është shpenzuar, ndërsa aktivitetet më të kushtueshme nuk janë realizuar. Mungesa e buxhetit dhe kapaciteteve janë identifikuar si pengesat kryesore për zbatimin e plotë të aktiviteteve, megjithatë nuk është specifikuar përgjegjësia institucionale për këtë situatë. Kjo e bën të qartë se mungesa e financimit adekuat është një nga sfidat themelore për përmbushjen e strategjisë.
Strategjia për Sundimin e Ligjit është ndërtuar mbi parimin e sinkronizimit me planifikimin buxhetor qeveritar. Sidoqoftë, raportet e zbatimit tregojnë se kjo nuk është arritur në praktikë. Pa mbështetje financiare të siguruar paraprakisht, dokumentet strategjike mbeten vetëm plane teorike që nuk kontribuojnë në përmirësimin e sundimit të ligjit në vend.
Komiteti Drejtues ka theksuar nevojën që Ministria e Financave dhe Kuvendi të marrin parasysh kërkesat buxhetore të institucioneve për realizimin e aktiviteteve të ngecura. Kjo përfshin jo vetëm sigurimin e fondeve të mjaftueshme, por edhe përcaktimin e qartë të përgjegjësive për të adresuar mungesat e buxhetit dhe për të siguruar zbatimin e qëndrueshëm të strategjisë.
Inadequate Budgeting: A Barrier to Implementing the Rule of Law Strategy (ROLS)
The 2023 Annual Report on the Implementation of the Rule of Law Strategy (ROLS) reveals that only 32% of the planned budget for the year was utilized, leaving the most resource-intensive activities unfulfilled. Budgetary constraints and limited institutional capacities have been identified as the primary obstacles to the full implementation of activities. However, the report does not assign institutional accountability for this shortfall, underscoring that inadequate funding remains a fundamental challenge to achieving the strategy’s objectives.
The ROLS was designed to align with governmental budgetary planning principles, but implementation reports indicate that this synchronization has not been realized in practice. Without secured financial support, strategic documents risk remaining theoretical frameworks that fail to contribute meaningfully to strengthening the rule of law in Kosovo.
The Steering Committee has emphasized the necessity for the Ministry of Finance and the Assembly to consider institutional budgetary requirements to address stalled activities. This involves not only ensuring adequate funding but also clearly defining responsibilities to mitigate budgetary deficiencies and facilitate the sustainable implementation of the strategy.
