Prishtinë, 24 shkurt 2022 – Instituti i Kosovës për Drejtësi (IKD) me 18 shkurt 2023 në KTV, ka transmetuar emisionin “Betimi për Drejtësi” me titull “Përplasjet institucionale për Agron Bekën”, në të cilin ishin shpalosur pretendimet për shkelje të ligjit nga Agron Beka dhe të tjerët në Universitetin e Mitrovicës “Isa Boletini”. Emisioni “Betimi për Drejtësi” me qëllim të trajtimit sa më profesional dhe të drejtë të hulumtimit të kësaj teme, kishte ftuar edhe Bekën që të ofrojë qëndrimin e tij lidhur me këto pretendime të shkeljes së ligjit, por që ai ende pa e kuptuar temën për të cilën e kemi ftuar të intervistohet, ka filluar me kërcënimet e tij se do të ushtrojë padi. Edhe pas kësaj, ekipi i “Betimit për Drejtësi” prapë ka insistuar që të intervistohet Beka por ai vazhdimisht ka refuzuar.
Agron Beka si pjesë e stafit akademik në Universitetin e Mitrovicës, në të njëjtën kohë ushtron edhe funksionin e anëtarit të KPK-së nga radhët e profesorëve të fakulteteve juridike. Beka me datë 23 shkurt 2023, në takimin publik të KPK-së, ka propozuar që në rendin e ditës të shtohet edhe pika ku do të diskutohet për Institutin e Kosovës për Drejtësi dhe emisionin “Betimi për Drejtësi”. Ai, gjatë këtij diskutimi, duke keqpërdorur pozitën e tij si anëtar i KPK-së, ka sulmuar IKD-në dhe “Betimin për Drejtësi” me gjuhë ofenduese, fyese dhe degraduese, me arsyetimin se emisioni ku ai ishte protagonist ishte i porositur dhe tendencioz.
Për më tepër, Agron Beka, duke tentuar të hakmerret dhe të ndalë raportimet për të përmes transmetimit të hulumtimeve gazetareske, ku ai shpërfaqet përmes kallëzimeve penale si i dyshuar për keqpërdorim të detyrës zyrtare, ka kërkuar që drejtuesi i IKD-së, Ehat Miftaraj, i cili kishte punuar si Drejtor i Njësitit për Shqyrtim të Performancës së Prokurorive në KPK prej 2011 deri në 2015 të “hetohet” deri në detaje nga administrata e KPK-së, duke kërkuar edhe qasje në dosjen e Miftarajt për kohën sa ai ka qenë drejtor i këtij njësiti.
Beka po ashtu ka kërkuar informacione në lidhje me donacionet, që sipas tij, KPK i ka bërë “Betimit për Drejtësi”. “Po ashtu, do të kërkojë informacion zyrtar se e a ka pas donacion nga ana e KPK-së që i kanë bë “Betimit për Drejtësi” në vlerë prej 80 mijë euro edhe a ka pas donacione tjera”. E gjithë kjo për shkak të publikimit të një emisioni, ku ai në mënyrë kategorike ka refuzuar ta jap versionin e tij.
Në fund të fjalimit të tij në mbledhje të KPK-së, Agron Beka sërish ka ngritur akuza të rënda ndaj IKD-së dhe emisionit “Betimi për Drejtësi”, duke thënë se kjo OJQ është bërë pjesë e një grupi abuziv, duke aluduar tek zyrtarët të cilët kanë ngritur kallëzime penale për abuzime të ligjit kundër Agron Bekës.
Qasja dhe diskutimi i Bekës bie në kundërshtim me obligimet dhe përgjegjësitë e tij që dalin nga Ligji për KPK. Sipas këtij ligji, Kryesuesi, zëvendës-kryesuesi dhe anëtari i Këshillit ushtrojnë detyrat e tyre në mënyrë të pavarur, profesionale dhe të paanshme. Në rastin konkret, Agron Beka keqpërdor pozitën e tij zyrtare dhe për interesa personale mbi çështjet që nuk hyjnë në kuadër të kompetencave të KPK, kërkon që të hetohen një OJQ e pavarur dhe komponenta e saj për media – emisioni “Betimi për Drejtësi”. E gjithë kjo për shkak të publikimit të një emisioni, ku ai shpërfaqet përmes kallëzimeve penale si i dyshuar për keqpërdorim të detyrës zyrtare, në të cilin ai ka refuzuar të intervistohet.
Para transmetimit të emisionit “Betimi për Drejtësi”, protagonisti Agron Beka ka qenë subjekt i raportimit edhe nga mediat e tjera për pretendimet për përfshirjen e tij në shkelje të ligjit.
IKD është themeluar me 4 shkurt 2009 dhe asnjëherë nuk ka marrë fonde nga asnjë institucion publik, përfshi KPK-në. Tendenca që në publik të plasohen të pavërteta “nëse IKD ka pranuar mjete nga KPK”, hyn në vazhdën e shpifjeve të Agron Bekës dhe përpjekjeve për të plasuar informacion të rremë në publik.
Sa i përket rolit të shoqërisë civile, IKD i rikujton Bekës se Strategjia për Sundimin e Ligjit 2021-2026, në parimet bazë ka përcaktuar se shoqëria civile dhe media luajnë rol kyç në monitorimin e rritjes së ndërgjegjësimit për të gjitha çështjet e drejtësisë. Gjithashtu, shoqëria civile si akter i pavarur që përfaqëson interesat e publikut të gjerë, është e pozicionuar në mënyrë unike për të denoncuar dhe ekspozuar praktikat e këqija, rastet e korrupsionit, si dhe për të bërë presion për reforma. Prandaj, institucionet publike duhet të marrin masa për të mundësuar dhe forcuar pjesëmarrjen e shoqërisë civile, ndërsa shoqëria civile duhet të jetë e vetëdijshme për rolin e saj dhe të përdorë levat e saj të mundshme.
Në rastin e Agron Bekës, ai vepron në kundërshtim të hapur me këto parime dhe keqpërdorur autoritetin e tij zyrtar me qëllim të ndaljes së raportimeve ndaj tij, kur ai është subjekt i hulumtimeve nga shoqëria civile dhe media.
Me këtë rast, IKD dhe “Betimi për Drejtësi” i rikujton Agron Bekës se tendencat e tilla për të mbyllur gojën e mediave nuk janë risi. Për situata të ngjashme, akterë të ndryshëm kanë pasur vazhdimisht tendenca të tilla. Por, të gjitha këto tendenca kanë dështuar dhe nuk e kanë penguar IKD dhe emisionin “Betimi për Drejtësi” të vazhdojë sukseshëm punën në ekspozimin e shkelësve të ligjit.
Keqpërdorimi i takimit publik të KPK nga anëtari i saj, Agron Beka, dëmton rëndë imazhin e KPK si institucion kushtetues që mbikëqyrë Prokurorin e Shtetit. Beka ishte zgjedhur anëtar i KPK nga Kuvendi i Republikës së Kosovës, ku kishte marrë gjithsej 33 vota. Me qëllim që Kuvendi të sigurohet që përfaqësuesit e saj të ushtrojnë në mënyrë të drejtë funksionin që u është besuar nga Kuvendi, në përputhje me Ligjin, duhet të ndërmarrin masa ndaj anëtarit Agron Beka.
Kosovo Law Institute reacts against the persecutory campaign against KLI and “Betimi për Drejtësi” by Agron Beka, member of the KPC
Pristina, 24 February 2022 – The Kosovo Law Institute (KLI) on 18 February 2023 on KTV, “Betimi për Drejtësi” transmitted the show titeled “Insitutional clashes for Agron Beka”, in which the allegations of violations of the law by Agron Beka and others at the University of Mitrovica “Isa Boletini” were disclosed. “Betimi për Drejtësi” in order to handle the investigation of this topic as professionally and fairly as possible, had also invited Beka to offer his position regarding these claims of violation of the law, yet without knowing the topic for which he was invited, he started to threaten with lawsuits. Even after this the “Betimi për Drejtësi” team still insisted that Beka be interviewed, but he repeatedly refused.
Agron Beka, as part of the academic staff at the University of Mitrovica, at the same time exercises the function of a member of the KPC from among the professors of the law faculties. Beka on 23 February 2023, at the public meeting of the KPC, proposed to add an item to the agenda where the Kosovo Law Institute and the show “Betimi për Drejtësi” will be discussed. During this discussion, misusing his position as a member of the KPC, he attacked the KLI and “Betimi për Drejtësi” with offensive, insulting and degrading language, on the grounds that the show where he was the protagonist was commissioned and tendentious.
In addition, Agron Beka, trying to take revenge and stop reporting on him through the broadcast of journalistic investigations, where he appears through criminal reports as a suspect for abuse of office, has requested that the head of the KLI, Ehat Miftaraj, who had worked as the Director of the Performance Review of Prosecutors Unit in the KPC from 2011 to 2015, to be “investigated” in detail by the KPC administration, also requesting access to Miftaraj’s file for the time he was director of this unit.
Beka also requested information regarding donations, which according to him, the KPC made to “Betimi për Drejtësi”. “Also, I will request official information on whether there is a donation from the KPC that they made to “Betimi për Drejtësi” in the amount of 80 thousand euros and whether there are other donations.” All this because of the publication of a show, where he categorically refused to give his version.
During the end of his speech at the KPC meeting, Agron Beka again raised serious accusations against KLI and “Betimi për Drejtësi”, stating that this NGO has become part of an abusive group, alluding the officials who have filed criminal charges to violations of the law against Agron Beka.
Beka’s approach and discussion contradicts his obligations and responsibilities arising from the Law on KPC. According to this law, the Chair, vice-chair and members of the Council exercise their duties in an independent, professional and impartial manner. In this particular case, Agron Beka abuses his official position and for personal interests on issues that do not fall within the competences of the KPC, he demands that an independent NGO and its media component – the show “Betimi për Dretësi” be investigated. All of this because of the publication of a show, where he appears through criminal reports as a suspect for abuse of office, in which he refused to be interviewed.
Prior to the broadcasting of the show “Betimi ër Drejtësi”, the protagonist Agron Beka was the subject of reports from other media about the claims of his involvement in violation of the law.
KLI was established on 4 February 2009 and has never received funds from any public institution, including the KPC. The tendency to publish untruths “if they have received funds from the KPC” comes in the wake of Agron Beka\s defamation and attempts to publish false information to the public.
Regarding the role of civil society, KLI reminds Beka that the Strategy for the Rule of Law 2021-2026, in its basic principles, has determined that civil society and the media play a key role in monitoring the increase of awareness for all issues of justice. Also, civil society, as an independent actor representing the interests of the general public, is uniquely positioned to denounce and expose bad practices, cases of corruption, and to press for reforms. Therefore, public institutions must take measures to enable and strengthen the participation of civil society, while civil society must be aware of its role and use its possible levers.
In the case of Agron Beka, he acts in open opposition to these principles and misuses his official authority in order to stop reporting on him, when he is the subject of investigations by civil society and the media.
On this occasion, KLI and “Betimi për Drejtësi” reminds Agron Beka that such tendencies to silence the media are not new. Similar situations were consistently attempted by different actors with such tendencies. However, all these attempts have failed and have not prevented KLI and “Betimi për Drejtësi” to successfully continue their work in exposing law breakers.
The misuse of the public meeting of the KPC by its member, Agron Beka, severely damages the image of the KPC as a constitutional institution that oversees the State Prosecutor. Beka was elected a member of the KPC by the Assembly of the Republic of Kosovo, where he received a total of 33 votes. In order for the Assembly to ensure that its representatives properly exercise the function entrusted to them by the Assembly, in accordance with the Law, they must take measures against member Agron Beka.
