Pristina, July 16, 2025 – The Kosovo Law Institute (KLI) considers the response of the acting Government to yesterday’s ruling of the Supreme Court of the Republic of Kosovo completely unacceptable. The Court determined that Administrative Instruction (MFPT) No. 01/2025 on the Use of Fiscal Electronic Devices, Fiscal Systems, and Fiscal Electronic Software is unlawful and annulled it.
Public opposition by the executive branch to a ruling of the highest regular court not only constitutes interference with judicial independence, but also represents a blatant violation of the separation of powers—the cornerstone of constitutional order in a democratic state—while undermining the integrity of the judiciary and fostering institutional distrust.
Moreover, KLI considers the approach of Mr. Hekuran Murati extremely dangerous, as he publicly named and targeted the Supreme Court judges. This behavior, in addition to undermining the integrity of the judicial system, poses a risk to the personal safety of the judges involved.
The reactions of the acting Government and its members constitute unnecessary pressure on the judiciary, threatening institutional independence and efforts to build impartial justice. KLI recalls that public trust in the judicial system is built through respect for its decisions, not through their delegitimization by political officials.
Yesterday’s Supreme Court ruling establishes an important precedent to prevent political interference in administrative decision-making and sets a new standard for respecting the separation of powers in practice.
KLI emphasizes that the Supreme Court rightly determined that issuing an Administrative Instruction by a person simultaneously serving as a member of parliament and a minister is illegal and violates constitutional provisions. Accordingly, the administrative instruction has been declared unlawful and annulled, as it was issued by an official without a valid mandate and in clear functional incompatibility.
KLI calls on all institutional representatives to respect the integrity of judicial decisions and to refrain from any action or statement aimed at undermining the authority of the courts. Only through an independent and functional judiciary can legal certainty and the rule of law be ensured.
